Terms of Service

1. Acceptance of terms

By creating a Pulse account or by placing the Pulse tracking snippet on any website, you agree to be bound by these Terms of Service. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these terms, do not use the service.

These terms form a binding agreement between you and Quicker Tools, operated by its sole founder in Gatineau, Quebec, Canada. References to "Pulse," "we," "us," or "our" mean Quicker Tools. References to "you" or "your" mean the account holder.

2. Service description

Pulse Analytics is a privacy-first web analytics platform delivered as a software-as-a-service. The service runs on Cloudflare Workers and Cloudflare D1 infrastructure. It provides website owners with anonymised, aggregate data about traffic to their sites, including pageview counts, referrer data, geographic summaries, campaign attribution, and related metrics. The service may include additional modules (SEO analysis, AI visibility tracking, content intelligence, and others) that are added over time. Access to specific modules depends on your subscription tier. We reserve the right to add, modify, or remove features with reasonable notice.

3. Account responsibilities

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, whether or not you authorised it. If you suspect unauthorised access to your account, notify us immediately at hello@pulse.quicker.tools. We are not liable for any loss resulting from unauthorised account access caused by your failure to secure your credentials.

You must provide accurate information when creating your account. You may not create accounts on behalf of others without their authorisation or impersonate any person or entity.

4. Acceptable use

You agree to use Pulse only for lawful purposes and in a manner consistent with all applicable laws and regulations. Specifically, you must not:

  • Use Pulse to track websites directed primarily at children under the age of 13, or to collect analytics from pages where you have reason to believe the majority of visitors are under 13, without first obtaining appropriate parental consent and implementing all required legal safeguards under COPPA (US), GDPR Article 8 (EU), or equivalent laws in your jurisdiction.
  • Resell, sublicense, or white-label the Pulse service to third parties without our prior written permission.
  • Attempt to reverse-engineer, decompile, or extract the source code of Pulse's backend systems or proprietary algorithms.
  • Use the service in a way that could damage, disable, or impair the infrastructure or interfere with any other party's use of the service.
  • Use the service to collect data from websites you do not own or have explicit permission to instrument.
  • Circumvent any rate limits, access controls, or security measures.

We reserve the right to investigate suspected violations and to suspend or terminate accounts that breach these terms.

5. Subscription, billing, and cancellation

Pulse offers a free tier with limited data retention and feature access. Paid subscriptions unlock additional features and higher data limits. Current pricing is described on the pricing page.

Paid subscriptions are billed monthly in advance via Stripe. By providing payment details, you authorise us to charge your payment method on a recurring monthly basis. Charges are made at the start of each billing period. All prices are in USD unless otherwise stated.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. We do not issue refunds for partial months, unused features, or data that was collected during an active subscription period.

If a payment fails, we will retry the charge and notify you by email. If payment cannot be collected after reasonable retry attempts, your account will be downgraded to the free tier and your data may be subject to the free tier's retention limits.

We may change pricing with 30 days' notice. Price changes will not take effect for your existing subscription until your next renewal after the notice period.

6. Intellectual property

You own your data. The analytics data generated by your websites, including all aggregated reports and exports produced by Pulse, belongs to you. We do not claim any ownership over your website content or the traffic data associated with it. You may export or delete your data at any time.

Pulse owns the platform. The Pulse software, interface, algorithms, documentation, and all associated intellectual property are owned by Quicker Tools and are protected by copyright and other intellectual property laws. These terms do not grant you any ownership interest in the platform. You receive a limited, non-exclusive, non-transferable licence to use the service for the duration of your subscription.

7. Service availability

We aim to keep Pulse running reliably. However, we do not guarantee any specific level of uptime for accounts on the free tier or the Vitals tier. No service-level agreement (SLA) is offered at those tiers. Higher tiers may offer uptime commitments; see the pricing page for current details.

We may perform scheduled or emergency maintenance that temporarily affects availability. We will provide advance notice of scheduled maintenance where possible. We are not liable for losses caused by service interruptions, data processing delays, or infrastructure outages beyond our reasonable control.

8. Termination

You may cancel your account at any time from your account settings. Upon cancellation, we will retain your data for 30 days to allow for export, after which it will be permanently deleted.

We may suspend or terminate your account immediately if you breach these terms, engage in fraudulent activity, or cause harm to the service or other users. In cases of termination for cause, no refund will be issued for the remaining portion of any billing period. We will make reasonable efforts to notify you before termination unless the circumstances require immediate action.

9. Limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that the data it produces will be perfectly accurate.

To the maximum extent permitted by applicable law, our total cumulative liability to you for any claims arising from or related to these terms or the service will not exceed the total fees you paid to us in the three calendar months immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. If you are located in such a jurisdiction, some of the above limitations may not apply to you.

10. Governing law and disputes

These terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. Any dispute arising from or relating to these terms or the service will be subject to the exclusive jurisdiction of the courts located in Gatineau, Quebec. If you are a consumer located in the EU, you may also have the right to bring proceedings in your local courts under applicable EU law.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the revised terms. If you do not agree to the revised terms, you must cancel your account before the effective date.
